Below are brief descriptions of the major family-related permanent (immigrant) visas, listed in order of preference. Most immigrant visa applicants qualify for permanent resident status on the basis of a family or employer relationship. In both instances, prior approval by the INS of an underlying petition filed on the applicant's behalf is a pre-requisite to applying for permanent residence or adjustment of status.


Immediate Relatives of U.S. Citizens
(Unlimited visas available without reducing the total allotted number)
The spouse, unmarried child (under 21 years), parent, widow or widower of a U.S. citizen, or an orphan child under 16 years adopted by a U.S. citizen.


First Preference
Unmarried child (21 years or older) of a U.S. citizen


Second Preference (A)
Spouse or child (unmarried and under 21 years) of a legal permanent resident.


Second Preference (B)
Unmarried child (any age) of legal permanent resident.


Third Preference
Married child (any age) of U.S. citizens.


Fourth Preference
Siblings of U.S. citizen (U.S. citizen must be 21 years or older).
